Chairman Chris Smith (NJ-4) called the failure to follow existing federal laws inexcusable and, later following the hearing, introduced new legislation, the Servicemembers Legal Protections Act of 2004 (H.R. 4658).

The Committee heard compelling personal testimony from Ms. Tammy Kimmel (left), Mr. Jason Burris (center), and Ms. Judithe Kaplan (right).

Deputy Assistant Secretary Charles Ciccolella (3rd from left) discussed the Department of Labor's efforts to educate employers about Guard and reservists rights under USERRA.  Also testifying were (from L to R): Col.
